Case Model: Roper

Roper v. Secretary of Health and Human Services,
Office of Special Masters, No. 00-407V
Filed: December 9, 2005

  • Tetanus vaccine
  • Chronic gastroparesis
  • Entitled to compensation

Petitioner Colleen Berry Roper alleged that the tetanus vaccination that she received on July 10, 1997 caused her condition of chronic gastroparesis.

Special Master Hastings found that the petitioner demonstrated that her chronic gastroparesis was caused in fact by that vaccination, and thus she was entitled to compensation.

The reasoning of the Special Master exhibits the following features:

  • He finds Prong 1 of Althen to be satisfied on the basis of case reports, without epidemiology;

  • The reasoning under Prongs 1 and 2 of Althen exhibits general patterns; and

  • The decision discusses and applies factors relevant in assessing the comparative credibility of two experts.
